You can start – just not finish – estate planning with AI

Artificial intelligence tools have made it easier than ever to begin the estate planning process. With just a few prompts, AI can help you draft a basic will, create a list of assets or explain the roles of executors and trustees. 

For those just starting to think about how to protect their legacy, these tools can offer a helpful introduction to the broader process of estate planning. But when it comes to finalizing your estate plan, relying solely on AI is risky—and could leave you and/or your loved ones with more problems than solutions.

Benefits and limitations 

AI can be a great organizational tool. It might help you identify what types of documents you will need, such as a will, trust, power of attorney and advance healthcare directive. It can also explain legal terms in simple language or give examples of common estate planning goals. For many people, using AI can reduce the anxiety of getting started by offering structure and guidance before they meet with an attorney.

However, AI cannot replace personalized legal guidance and support. It does not know your family dynamics, financial situation or state-specific laws. Estate planning is about more than drafting documents—it is about making sure your wishes are carried out in a way that is legally valid and financially sound. An AI-generated will might not reflect current state requirements, or it may fail to address unique needs. The same can be said of an AI-generated advance directive. 

Errors in an AI-generated estate plan may not become apparent until it is too late—after your incapacitation or death, when the documents are needed most. At that point, mistakes or vague language can lead to confusion, court challenges and family disputes. Even minor oversights can cause significant delays and expenses in probate.

Using AI to begin your estate planning journey is fine—it can help you get organized and understand the basics. But to create a lasting, enforceable plan that truly protects your interests, professional legal guidance is a step you cannot skip.
